Fibromyalgia

This is a condition characterised by pain, non-restorative sleep and a host of other symptoms. It may develop spontaneously (primary fibromyalgia) or may be triggered by an accident (post-traumatic fibromyalgia). The trauma may be caused by a sudden forceful injury to the muscles such as in a whiplash injury, injury from a fall, being struck by an object or a back sprain from sudden lifting of a heavy object. Alternatively, it may stem from a more subtle, gradual trauma such as shoulder strain in an assembly-line worker or wrist strains in a computer operator.

It could be several weeks or months before the initial injury develops into FM and even longer until it is diagnosed. A doctor with experience in FM (usually a rheumatologist or pain consultant) will be able to check for painful tender points and diagnose FM from those and from a person’s medical history.

Evered -v- Bussell Judgment

Jayne Evered recovered very substantial damages after making a claim. She had been injured in a road accident on 6th November 2000 which was the other driver’s fault. Jayne suffered a whiplash injury which developed into fibromyalgia. The main issue in the case was whether the fibromyalgia was caused by the accident. The judge considered all the medical evidence and more.
