Personal injury claims rise in Ireland

Irish insurance firms paid out €200 million (£175 million) in personal injury claims last year, new research shows.

The Injuries Board findings reveal that 25,919 new claims were made in 2009, a five per cent increase on the previous year.

However, there was also a reduction in the number of successful claims while the rise in unemployment meant that there were fewer workplace-related accident claims.

"In the year ahead, we would anticipate that the average award may fall as we deal with less workplace accidents, which tend to attract the higher award," said Patricia Byron, chief executive of the Injuries Board.

The research found that the average award was €23,163 last year - a significantly lower figure than the 2008 average.

In addition, it was suggested that despite the high number of injuries sustained from trips and falls as a result of the freezing conditions in recent weeks, such accidents would result in few claims as compensation would only arise if the injury arose from negligence by another party.

A recent report by the Court of Appeal judge Lord Justice Jackson proposed that damages for personal injury claimants in the UK should be increased.
